 Post subject: Silencer transfer to FFL

If I (FFL/SOT) am transferring a silencer from my company on a Form 4 to a FFL (sole proprietor) without SOT, will the transfer be any faster than if I did the transfer to a normal individual.

I don't see any reason why it would be faster....

Although it could be, I guess... maybe.

My guess would be no.

Form 4, like grifter is doing. He's (the recipient) a sole proprietor, then it'll just be the same as transferring to another indivuidal, this individual just happens to have an FFL also.

And the transfer can go direct to out of state FFL on one form 4 tax no need for a NFA dealer.

Yes who would have guessed that having a federal firearms license allows you to order gun direct from sources outside of your state of residence.

Do FFLs even read the books on rules that the ATF sends them.

I'm not talking about guns, I'm talking about suppressors, as stated in the above post.

Sounds like another reason to get a C&R. I didn't think suppressors were on the list.

Or did I get confused somewhere?

You cannot use a C&R.

A "Form 4" is a tax paid transfer of an NFA device.

A "SOT" is when an FFL pays the taxes in advance (in theory saving money) and can transfer on a "Form 3" with no additional taxes.

Non-FFL's can _ONLY_ transfer on Form 4 (Form 5's not-withstanding)
FFL's can transfer on Form 4 + $200, or Form 3 if they have paid their SOT.

I'm not an FFL, but that's what I understand.

Yes. I have recieved three(on form 4), and they can be transfered across state lines from the manufacture oR SOT. Place in A&D book as recieved, and transfered to personal collection

No faster. Hell, I just had a SOT to SOT Form 4 transfer (two actually) and it took about four months, finally approved about two weeks ago.

And everyone who says non-SOT FFLs can directly receive NFA is correct. Just remember that they have to meet all the other requirements (prints, pics, CLEO signoff).

What I've been idly wondering is if any Type 02 FFLs have tried it. Pawnbrokers are dealers too, unlike 03s or 06s...

So if I got a C&R, I could get title 2 items such as suppressors sent to me directly so long as I filed the form-4? But I could not get the SOT that would let me go on a Form-3. Is that correct?

Can a trust have a C&R?

The only advantage to that would be getting by without the CLEO, fingerprints, and photos.

Direct receiving of firearms by a C&R is only for C&R weapons. That is spelled out very clearly. A C&R can ONLY receive a C&R arm, period. A C&R cannot sign up and pay the SOT.

No. A corp can have a C&R though.

Only because it would be a corp transfer (assuming the corp had a C&R), no different than any other corp transfer and you still cannot receive the item directly, it must go through a dealer in state and at that point the C&R becomes irrelevant.
